Single & Mirror Wills
A Will is one of the most important documents you will produce in your life, whether
you are single or part of a couple (Mirror Will). Your Will allows you to express
your wishes and determine how your loved ones will benefit from your estate. We
will talk you through all of the options available to you and ensure that you have
all of the necessary advice at your fingertips before making such an important decision.
This service will include updating or rewriting existing Wills.
Severance of Joint Tenancy
This is a useful tool for numerous reasons. If you and your partner are joint tenants
of a property you may wish to sever the tenancy for tax, ownership or succession
purposes. This process of effectively splitting the property into defined shares
involves a legal process called Severance of Joint Tenancy. You subsequently become
tenants in common of the property.
Property Protection Trust
Setting up a Protective Property Will allows clients to protect their property from
the Community Care Act of 1990.
Last year, 70,000 homes (200 every day) were taken by Councils throughout the UK
to recover Long Term Care costs. A protective Property Will could have prevented
this action.
Should a person having total assets in excess of around £20,000 go into care, without
a Protective Property Will, that person is liable for their care costs. Having exhausted
any money available, the Council would then look to recover its costs by selling
the home
Living Will (Advance Directive)
An advance directive allows you to make a statement to your friends and family as
well as to medical practitioners. You can state what you wish to happen to you (and
what treatment you should receive) if you reach a point where medically you no longer
have a tolerable life.
Lasting Powers of Attorney
Introduced by the Government from 1 October 2007 to replace Enduring Powers of Attorney.
This is a much more detailed and technical document and requires professional advice.
An LPA ensures a person of your choosing can handle your affairs if you do not have
the physical or mental capacity to handle them yourself. We can explain this fully
to you and ensure that you have considered all aspects before completion.

Updating a Will
It is important to ensure your Will is up-to-date. Here are some points to consider:
- An existing Will can be updated using a codicil, or by
re-making your Will. It is usually better to re-make your Will.
- An existing Will may contain a legacy that has been distorted
by inflation.
- Your circumstances may have changed
- An existing Will may refer to an executor who may have
died.
Nominating a firm of Willwriters as joint executors is a safeguard .
